PLEASE READ THESE TERMS OF SERVICE OF VACAYSHARING CAREFULLY.

Welcome to VacaySharing, a platform developed, owned, and operated by Jurišić Ventures d.o.o., Županići 4d, Zagreb, Croatia, OIB: 31167311698 (hereinafter ‘we,’ ‘us,’ or ‘VacaySharing’).

These Terms govern your access to and use of the services provided by VacaySharing on our platform, which includes vacation home profiles, member dashboards, co-ownership management, and other related features (collectively referred to as the “Services”) available to our registered users (“Members”).

1. ACCEPTANCE OF TERMS

These Terms apply to all users of the VacaySharing platform.

By registering or using the Platform, you confirm that you have read, understood, and agreed to be bound by these Terms.

If we make updates to these Terms, we will notify registered users and publish the updated version on our website.

2. DEFINITIONS

Member – A registered user who purchases a share in a vacation property through the Platform.

Platform – The digital interface through which VacaySharing provides its Services.

Property Share – One-eighth ownership in a specific vacation home, representing the right to 45 days of annual usage.

Secondary Market – A feature on the Platform enabling Members to resell their Property Shares.

3. ELIGIBILITY

Services are intended for individuals 18 years or older who have legal capacity. By using the Platform, you confirm that your use is permitted by the laws in your jurisdiction.

4. REGISTRATION

To use the Platform, you must complete the registration process and provide accurate personal information. We may approve or deny registrations at our sole discretion.

5. SERVICES AND FEATURES

VacaySharing provides access to:

• Carefully curated vacation homes available for co-ownership
• The ability to purchase one or more shares in a property (each providing 45 days of annual usage)
• Access to a digital calendar for reserving your days
• Optional subletting of unused days via the Platform
• Professional property management services
• A Secondary Market to resell your share

We may change or discontinue services with notice. VacaySharing reserves the right to suspend or terminate any account for violations of these Terms.

6. FEES AND PAYMENTS

• Purchase Fee: A one-time service fee upon acquiring a property share
• Management Fee: A recurring fee covering cleaning, maintenance, and service management
• Secondary Market Fee: A transaction fee applied to both buyers and sellers for each resale

We may update fees or payment methods at our discretion.

7. ACCEPTABLE USE

You agree not to:

• Use the Platform for unlawful or abusive purposes
• Provide false personal information or impersonate others
• Attempt unauthorized access to other user accounts
• Upload malicious software
• Interfere with the functionality or security of the Platform

Violations may result in account suspension or termination without prior notice.

8. INTELLECTUAL PROPERTY

All content on the Platform is the intellectual property of VacaySharing or its licensors. Use, reproduction, or redistribution of content is prohibited without prior written consent.

Any content you upload remains yours, but you grant us a license to use it for purposes of providing our services.

9. SUPPORT AND AVAILABILITY

For support, contact: [email protected]. We aim for 99% uptime but do not guarantee uninterrupted service.

10. THIRD-PARTY LINKS

Our Platform may include links to external websites. We are not responsible for the content, terms, or privacy practices of these third-party sites.

11. LIMITATION OF LIABILITY

VacaySharing provides services “as is” without warranties. We are not liable for indirect or consequential damages, user actions, or force majeure events.

12. INDEMNIFICATION

You agree to indemnify and hold VacaySharing harmless from any claims arising from your misuse of the Platform or violation of these Terms.

13. TERM AND TERMINATION

These Terms remain in effect until your account is deactivated or terminated. You may delete your account anytime by contacting [email protected].

We may suspend or terminate accounts without notice for violations of these Terms.

14. MISCELLANEOUS

14.1 Notifications Notices may be sent via email or through the Platform.

14.2 Severability If any part of these Terms is deemed invalid, the remainder shall remain in effect.

14.3 Assignment You may not transfer rights or obligations under these Terms without written consent.

14.4 Governing Law These Terms are governed by Croatian law. Disputes will be settled by the competent courts in Zagreb, Croatia.
